A temporary worker only has an trial period when an employment contract is entered into for a duration of at least three months. In this case the maximum trial period mentioned in the law is applied.


Does an temporary worker get an contract? 

A temporary worker getting a contract depends on the company where the temporary employee will be working. The temporary worker does however always sign a contract with the employment agency. 

The NBBU-collective employment agreement works with a four phase system. Phase 1 lasts 26 work weeks. In this period the temporary worker will get weekly contracts that end when the job ends or at the end of the week. After the temporary worker has been in phase 1 for 26 weeks, he goes over to phase 2. This phase will have an maximum duration of 104 worked weeks, once again with weekly contracts. After this in phase 3 an employment contract will be entered into for a certain time period. A maximum of 4 contracts can be given out for an maximum time period of 52 weeks. After an temporary worker has walked through phase 3 he will enter phase 4. In phase 4 he will enter an contract with an indefinite period of time

Does Recruit a Student have an separate collective labour agreement? 

Recruit a Student uses the NBBU-collective labour agreement. De NBBU is the Dutch association for brokerage and employment agencies. All the terms off employment that are applicable on temporary workers  can be found in the NBBU-collective labour agreement, these have to be same as the ones mentioned in the collective labour agreement off the hirer.


Is an temporary worker entitled to an refund of travel expenses?

The NBBU-collective labour agreement states that an temporary worker has the same rights as an regular worker regarding refunds of travel expenses. In most cases this doesn’t apply to students from Recruit a Student. This is because most off our students have an public transportation year card.


Is an temporary worker entitled to vacation days? 

A temporary worker earns vacation days over his earned salary. After working complete workweeks for a whole year the temporary worker is entitled to at-least four times the agreed upon weekly working hours. A temporary worker who doesn’t work complete workweeks or not consistent through the year, will build up an proportional amount. The temporary worker can choose to have these hours payed out as payed vacation or will get them payed out at the end of the employment agreement.


What is the notice period for temporary workers? 

There are different notice periods for temporary workers than for regular employees. The notice period for a temporary worker can be found in the collective labour agreement.

In phase 1 and 2 and temporary worker can quit at any time. As long as he gives notice one day before his last workday. The employment agency has to give notice at least 7 days before the work will end.

An temporary worker that has an limited contract has the following notice period depending on the length of his contract:

Contract shorter than 3 months: 1 week

Contract between 3 and 6 months: 2 weeks

Contract longer than 6 months: 1 month

The employment agency always has an notice period of 1 month determined by law.

Who pays the temporary worker when he gets sick?

A temporary worker is insured through the dutch law for sick employees. Depending on the phase the employee is in, he wil be entitled to an sick-pay by the government or by the employer. When you hire an temporary worker through Recruit a Student, Recruit a Student will still be the employer. All costs regarding sickness of an temporary worker will fall upon Recruit a Student.
